RERA is the Real Estate Regulatory Authority announced by the Real Estate Bill in all states and federal territories. This Authority will be above the real estate regulator to ensure transparent transactions and provide clarity on governing and monitoring of real estate projects.

Previously the real estate sector in India was largely unregulated and unorganized, which left consumers with little or absolutely no clarity on the default promises made by the developers. This bill which will now be state-level RERA Act, benefits the consumers in the form of standardized processes and protect them with transparent functioning, leading for a boost in more deals and overall growth in this sector and eventually boosting Indian economy.

This kind of RERA Act is also present in other countries. End user issues are incorporated in the legal contract, not by the federal regulation. There are different real-estate licensing laws in addition to code of ethics for state-level US real estate transactions.

In the UK all investments in real estate development are regulated by the Financial Services Authority (FSA). All issues in property matters in the UK are regulated under the Property Misdescriptions Act 1991.

In India the Minister of Housing and Urban Poverty Alleviation has put light on this act with FAQs on RERA.

“The Real Estate Act” is intended to achieve the following objectives:

● Ensure accountability towards allottees and protect their interest;

● Infuse transparency, ensure fair-play and reduce frauds & delays;

● Introduce professionalism and pan India standardization;

● Establish symmetry of information between the promoter and allottee;

● Imposing certain responsibilities on both promoter and allottees;

● Establish regulatory oversight mechanism to enforce contracts;

● Establish fast- track dispute resolution mechanism;

● Promote good governance in the sector which in turn would create investor confidence.

● The rate of interest is required to be specified by the appropriate Government in the Rules.

● Open parking areas cannot be sold to the allottees.

● ‘Common areas’ and ‘community and commercial facilities’ are an integral part of the project, to be handed over to the Association of allottees.

● One common certificate for ‘occupancy certificate’ & ‘completion certificate’ covers all aspects and suffices the requirements under this Act.

● Occupancy certificate relates to the occupation of the apartment/building, which has provision for civic infrastructure such as water, sanitation and electricity and is habitable.

● Completion certificate relates to the completion of the entire project certifying that the project has been developed according to the sanctioned plan, layout plan and specifications, as approved by the competent authority.

● The determination of the estimated cost of the real estate project is necessary.

● Ongoing or Incomplete projects and future projects are covered under the Act.”

This reduction in home loans will benefit the new home buyers as well the old buyers who have availed the home loan on floating rates.

3) Higher loan eligibility: Higher loan eligibility is expected to increase due to lower interest rates and all cheque transaction. Till now, the cash component involved in property transactions in Indian real estate market is estimated at 25%. These cash transactions are usually higher in lands and high-end properties while it is lower in case of affordable home segments such as apartments and flats. Salaried buyers tend to prefer all cheque transactions while self employed buyers prefer paying more in cash. Home loans are usually not available for funding the cash component of the property. With reduction in cash component and increase in cheque component, the overall loan eligibility will increase benefitting home loan borrowers.

With demonetization, huge amounts of cash will be under the formal banking system. Banks with excess liquidity will sanction more home loans at lower interest rates thus benefitting the customers. All this, surely seems to bring happy news to the house hunters.

Glossary of Common Real Estate in India

Real Estate terms are evolving from local terms to standard terminology. With a professional real estate industry in place, it’s important to know the basic yet important terms of the industry:

1. Carpet Area: 

It is the actual usable area of an office/apartment/showroom etc. excluding the wall thickness. Simply put, it is area within the walls wherein you can lay a carpet.

2. Built-up Area: 

It is the total covered area of the apartment/office. It can be calculated as carpet area + wall thickness (internal +external) + balcony areas until the inside walls.

3. Super built-up Area: 

The built up area of a unit plus common areas proportioned to that unit form the Super Built-up area. Common areas include - lobby, lift shafts, staircases, covered club houses etc. It excludes open areas such as parks, roof terrace, gardens etc.

4. Floor Space Index (FSI):

Floor Space Index (FSI), also known as Floor Area Ratio (FAR) is the ratio of the Gross floor area of all floors combined (except areas exempted under specific regulations) to the total area of the plot. Higher the FSI/FAR indicates more dense construction.

5. Freehold property: 

It is the property where the chief title owner has conveyed the property in favor of the buyer by a sale deed with no restriction on the right of the property holder to further transfer the property. The ownership record of the freehold property can be ascertained from the sub-registrar office. The property can be transferred by registration of sale deed.

6. Credit Score: 

A statistically derived score of a person’s worthiness which is usually based on the person’s past credit history. It is generally used by the money lenders to ensure that likelihood of the person to repay his debts.

7. Conveyance: 

It is the act of transferring the rights, title, ownership & interests of a property from one person to the other. It also refers to the written document in the form of a deed or lease that legally transfers the title of the property from the seller to the buyer.

8. Per Square Foot Rate: 

It is a measurement unit, measuring the area in terms of a square with sides of 1 foot. The builders usually set the value of the property based on the per square foot rate of the super built-up area. That is why the super built-up area is termed as “Saleable area”.
